Intellectual Privacy Policy

ACS Technologies Group, Inc., and its affiliates, their officers, directors, employees, or agents (collectively referred to as "ACST") creates software solutions to help churches, schools, and organizations fulfill their missions. You may be a visitor ("Visitor") to our websites ("Websites") or a customer ("Customer" or "Licensee") who purchased or is using our products and services (collectively, "Services").

We have a direct relationship with Customers that have created an account or a site with us and pay for our Services (e.g. denominational alliances, diocese, organizations, churches, parishes). These Customers may share licensed access to their account or site with authorized churches, organizations, or individuals. They are all considered our Customers, but we have different responsibilities to those with whom we have direct relationships. We'll specify when we're referring to particular kinds of Customers, otherwise we'll refer to "you" generally.

Our Services are designed to help our Customers manage administrative duties, provide demographic data to plan for growth, and communicate with each other in a secure, online environment (e.g. chat, messaging, email, or by sharing posts and events).

Our Intellectual Property and Content

ACST has a number of registered trademarks, service marks, and copyrights in place to protect our intellectual property. No graphics, logos, and phrases may be used without prior written consent of ACST. For a non-exhaustive list of our registered trademarks, see our Trademarks. Any other trademarks, product names, company names or logos that display on the Websites are the property of their respective owners.

You acknowledge that Our Services and Websites contain software, images, videos, typefaces, graphics, music, sounds and/or other material (collectively, "ACST Intellectual Property and Content") that belong to ACST and is protected by copyrights, trademarks, and/or by other legal measures. ACST Intellectual Property and Content is protected in all forms, media, and technologies that exist now as well as in those that will exist in the future. You cannot modify, remove, participate in the transfer of sale of, create derivative works from, or otherwise wrongfully exploit any ACST Intellectual Property and Content.

As noted in our Privacy Policy, we consider ACST to be the Custodian of all data that is entered in our Services, including Customer and Visitor data (collectively referred herein as “Customer Data”). Customer Data that is stored in connection with our Services belongs to that Customer. Please note that you may not upload, post, reproduce, or distribute ACST IP and Content in any way without ACST’s written permission to use it.

Sharing Content Online

When using our Web-based Services to share content with others online:

  • You represent that you own the content you post and that you can control how it is shared based on the settings you select in those Services.
  • By the nature of these Services, when you share content publicly, you hereby grant ACST a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license (“IP License”) to use any content you post online, subject to the selections you chose in settings.
  • The IP License ends when you delete your content from your account or site. However, the IP License continues in force insofar as your content was shared with others. Essentially, your content may “live” forever.

Third-party Content

While ACST is a publisher of its own content, generally, ACST exercises no more editorial control over such content than does a public library or a newsstand. Any opinions, advice, statements, services, offers, or other information included in third-party content are those of the respective authors or distributors, and not of ACST.

Distributing or uploading third-party content to our Services

From time to time, Customers may want to upload, post, or share third-party content to our Web-based and mobile Services. Customers are responsible for the content that may be shared on their site or account. By sharing content on our Services, content becomes publicly available, and Customers automatically warrant that such content may be reproduced, shared, modified, or is otherwise free to be used by others.

Any content that is copyrighted or that is distributed with consent from the respective copyright owner should clearly note "Copyright owned by name of owner; used by permission."

In compliance with the Digital Millennium Copyright Act, anyone may report a copyright or intellectual property violation to us in writing to the address or email address provided at the end of this page. If you distribute content without authorization, you may be subject to criminal prosecution, and possibly personal liability for damages in a civil suit. You are responsible for damages resulting from any copyright, right of publicity, invasion of privacy and any other violation of proprietary or other rights that arises from any submission you may make.

You agree to indemnify, defend, and hold ACST harmless from and against any and all loss, costs, expenses (including reasonable attorneys' fees and expenses), claims, damages and liabilities related to or associated with this section of this policy. This includes any violation resulting from distributing or uploading unlawful third-party content to our Services.
